The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, January 27, 2025 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Chairman, Stephens. Roll Call Stephens present, Moore present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Moore led the Pledge of Allegiance and Invocation led by Whitehouse.

Item #4: Motion was made by Whitehouse and seconded by Moore to approve the minutes of January 21, 2025. Vote as follows: Stephens- Abstain, Moore - Aye, Whitehouse - Aye. A motion was made by Stephens and seconded by Whitehouse to correct the minutes from July 29, 2024 to January 6, 2025 on Item #1 stating Chairman, Whitehouse and correcting to Chairman, Stephens. Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-17 rezoning request CCZ-2154-Rebecca Gutierrez per recommendations of CCPC. Rezoning from Agricultural District to Heavy Residential District to allow a duplex. Murray stated that the lot did not meet requirements in size, so they did apply for a variance that was approved on 1/14/25. Tract is surrounded by Agricultural and Commercial Districts. There has been no opposition. Applicant is present. The CCPC recommended approval on 1/21/25, along with the Planning Office. Property located at 6248 S. 44th W. Avenue Tulsa, OK.-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #8: Motion was made by Whitehouse and seconded by Moore to sign Resolution#2025-18 rezoning request CCZ-2158 and lot split CCLS-3019-Rick Cole per recommendation of CCPC. Rezoning from Light Residential District to Residential Manufactured Home District to allow lot split for one manufactured home. Tract 1 will contain .62 acres more or less and meet all requirements of Residential Manufactured Home District. Tract 2 will contain .62 acres more or less and meet all requirements of Light Residential District. Tracts are surrounded by Light Residential, Agricultural, and Residential Manufactured Districts. Murray stated we did have one neighbor concerned with the property becoming a rental property and how that would depreciate their property. Murray stated the tracts will be for the owner and his sister-in-law. Applicant is present. The CCPC recommended approval on 1/21/25, along with the Planning Office. Property located at 7141 Cottonwood Road Sapulpa, OK 74066-Wendy Murray, Planner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #9: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2025-19 surplussing K9 Deputy Ranger Male German Shorthaired Pointer INV#1192 and Resolution#2025-19A disposing of the same to be retired and adopted by his K9 Handler, Dru Davis. The Board thanked Ranger for his years of service and asked how old Ranger was, Bowling replied eight years old. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #10: Motion was made by Stephens and seconded by Whitehouse to sign Resolution#2024-20 Proclamation in Recognition of Service and Retirement of K9 Deputy, Ranger. Bret Bowling, Sheriff and the Commissioners addressed the audience. It is with mixed emotions that we announce the retirement of K9 Ranger today. Joining us for this occasion are Ranger and his handler and partner of over six years, Sergeant Dru Davis. Ranger, a German Shorthaired Pointer, has been a valued member of the Sheriff's Office since his commissioning on October 01, 2018. His name, chosen through a countywide contest involving local grade schools, reflects the creativity of the bright children of Creek County. Certified through the Council of Law Enforcement Education and Training as a part of a Narcotics K9 team, and nationally recognized by the United States Police Canine Association in detention, Ranger has made significant contributions to public safety. Over his career, he has participated in 155 narcotics deployments, leading to the discovery of 261 pounds of marijuana, 28 grams of methamphetamine, 1 gram of heroin, and numerous unidentified pills. Ranger has also been involved in six missing person searches, providing vital assistance in critical situations. In addition to his investigative work, Ranger and Sergeant Davis have completed over 200 deployments in our schools and community events, as well as assisting local and state agencies with narcotics detection. Beyond his professional achievements, Ranger is known for his exceptional temperament, often seen engaging with the community, and an unwavering dedication, earning him the title of a "very, very good boy." Today, we honor Ranger's service to the citizens of Creek County and extend our gratitude for his contributions. He will be deeply missed, but his legacy will remain a proud part of the Sheriff's Office. Thank you, Ranger. Enjoy your well-deserved retirement.  Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #11: Motion was made by Stephens and seconded by Whitehouse to sign 2025 REAP Contract for purchase of a fire training container for the Olive Volunteer Fire Department and authorize the Chairman to sign all related documents, Contract #250131, in the amount of $60,000.00, funding period December 20, 2024 to June 30, 2026. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #12: Motion was made by Whitehouse and seconded by Moore to sign 2025 REAP Contract for purchase of an Excavator to address lead and copper rule requirements of lead and copper inventory and removal for Creek County Rural Water District #5 and authorize the Chairman to sign all related documents, Contract #250139, in the amount of $60,000.00, funding period December 20, 2024 to June 30, 2026. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #13: Motion was made by Moore and seconded by Whitehouse to sign 2025 REAP Contract to repave S. 433rd W. Avenue from HWY 33 North to W. 91st St. S., in District #2 and authorize the Chairman to sign all related documents, Contract #250228, in the amount of $150,000.00, funding period December 20, 2024 to June 30, 2026. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #14: Motion was made by Whitehouse and seconded by Moore to sign 2025 REAP Contract for asphalt overlay on S. 513th W. Avenue from HWY 66 to W. 271st St. S., in District #3 and authorize the Chairman to sign all related documents, Contract #250227, in the amount of $115,000.00, funding period December 20, 2024 to June 30, 2026. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #15: Motion was made by Stephens and seconded by Whitehouse to sign the Local Elected Official Consortium Agreement between Green Country Workforce Development Board and Creek County replacing Leon Warner with Zac Moore, District #2 Commissioner. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #16: Motion was made by Stephens and seconded by Whitehouse to sign Staffing Agreement with Express Employment Professionals for the Commissioners Office. Stephens stated this is to find a full-time Cleaner for the Courthouse and Collins Building. Stephens stated Andrew Goforth, Assistant District Attorney has reviewed and approved the contract. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #17: Motion was made by Whitehouse and seconded by Moore to Amend Resolution#2025-12, naming Newt Stephens, Jr, as the Alternate Representative to the CED #1 Board of Directors. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #18: Motion was made by Stephens and seconded by Moore for the Allocation of Beverage Tax to be distributed as follows Bristow $3,262.83; Depew $315.68; Drumright $1,966.30; Kellyville $782.68; Kiefer $1,679.80; Lawrence Creek $92.94; Mannford $2,505.50; Mounds $715.86; Oilton $679.76; Sapulpa $16,843.36; Slick $115.98. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #19: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from Cox Communications per County Spec for cable line, by boring, size of line 0.625", size of casing 2" conduit, to cross Overlook Dr. approximately 0.08 miles S. of HWY 117, further described as 458' S. of the N.W. corner of Section 5, T17N, R12E, in District #1. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #20: Motion was made by Stephens and seconded by Whitehouse to approve Utility Permit from ONE Gas Inc. per County Specs for natural gas pipeline by boring, size of line ¾", to cross W. 184th St. approximately 3.27 miles S. & 2.38 miles W. of Jct. US 75 & SH 67, further described as 1557' S. of the N.E. Corner of Section 5, T16N, R12E, in District #1. Vote as follows: Stephens - Aye, Moore - Aye, Whitehouse - Aye.

Item #21: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government.  Mortazavi stated we have filed and submitted the quarterly report.
