The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, July 22, 2024 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:00 a.m. by Vice-Chairman, Whitehouse. Roll Call Stephens absent, Rick Selsor, First Deputy present, Warner present, Whitehouse present.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Selsor and seconded by Whitehouse to sign Resolution#2024-119 rezoning request CCZ-2144 and lot split CCLS-2982-Cindy Barrett per recommendations of CCPC. Rezoning from Agricultural District to Light Residential District to allow lot split. Tract 1 will remain Agricultural District, contain 19.33 acres more or less and meet all requirements of Agricultural District. Tract 2 will contain 0.54 acres and meet all requirements in Light Residential District. Tracts are surrounded by Agricultural to the north, east and south, to the west is Light Residential. Murray stated this will bring the tract into compliance with the ongoing efforts in cleaning up zoning throughout the county. The tract also has a Teel Road that divides the two tracts. There has been no opposition. Applicant is not present. The CCPC recommended approval on 7-16-24, along with the Planning Office. Property is located at 14601 Teel Road Sapulpa, OK 74066-Wendy Murray, Planner. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Selsor and seconded by Warner to sign Resolution#2024-120 rezoning request CCZ-2145-Hope Parnell per recommendations of CCPC. Rezoning from Light Residential District to Residential Manufactured Home District to allow one manufactured home. Murray stated this is one lot and will meet all requirements of Residential Manufactured Home District. Tract is surrounded to the north and south Residential Manufactured Home District, east Agricultural District, west Light Residential District. This property was platted in 1980 as Light Residential, then in 2010 sixty lots were rezoned to Residential Manufactured Home District, and the remaining lots stayed Light Residential. Applicant was not aware when it was purchased that the tract was not zoned Residential Manufactured Home District. Applicant is present.  The CCPC recommended approval on 7-16-24, along with the Planning Office. Property is located at 18435 S. 80th W. Avenue Mounds, OK-Wendy Murray, Planner. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Abstain.

Item #9: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2024-121 approving Final Plat for "Barrett Ridge Estates", a proposed single-family subdivision, containing 40 acres, more or less. Murray stated the tract is surrounded to the north by Agricultural and Light Residential, to the east, south, and west is Agricultural as well. The Applicant is present. The CCPC recommended approval on 7-16-24, along with the Planning Office. Property is located at 9032 W. 151st St. S. Sapulpa, OK 74066-Wendy Murray, Planner. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #10: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2024-122 creating a Self-Insured County Deducutible Account 1237-1-2000-2005, for Workman's Compensation. Mortazavi stated that this is correcting the action last week, that we tried to setup this account. Paramount Claims, will not administrate our workman's compensation claims as approved by the Board last week. So, we are needing to create an internal county self-insured deductible fund to cover claims from $0.00 to $2,000.00, on claims that are not going to be sent CompSource. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Warner and seconded by Whitehouse to amend motion made on 7-15-24, for $100,000.00 to $80,000.00 for Self-Insured Deductible Fund with Paramount and approve Error Correction of $20,000.00 from 1301-1-0800-2005 Use Tax Commissioners FY2024-2025 to 1237-1-2000-2005 Self-Insured Deductible Fund Commissioners FY2025 County Fund for Workman's Compensation Account 1237-1-2000-2005. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Selsor and seconded by Whitehouse to sign Account Control Acknowledgement for Self-Insured Deductible Fund with Paramount Claim and the Board of County Commissioners. Mortazavi stated this is for our Self-Insured Deductible Fund that the TPA will administer and Andrew Goforth has reviewed. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Whitehouse and seconded by Warner to sign Inter-Cooperative Agreement between Creek County and U.S. Army Corps of Engineers for District #1, for remainder of fiscal year 2024-2025. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Warner and seconded by Whithouse to approve tuition cost for CDL Training for employees, specifically Garrett McCrackin, to attend Drumright Vo-Tech with Green County Workforce reimbursing part of the fee back to District #2. Warner stated we have done this in the past, a little bit has changed. We have to pay for the cost upfront, in the amount of $4,800.00, then we are reimbursed more than 50%, upon completion. We have also created an agreement that the employee must sign that they will stay employed for two years or they will have to refund the county a portion, if they leave before agreement has been fulfilled. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Motion was made by Whitehouse and seconded by Warner to sign Resolution#2024-123 directing the Creek County Treasurer to credit the Creek County Sheriff Accounts 0001-2-0400-2005/B2; 0001-2-0400-4110/B3; Juvenile Justice Accounts 1317-2-0400-2005/JJC2; 1317-2-0400-2017/JJC6 and Sheriff's Service Fee Accounts 1226-2-0400-2005/SSF2; 1223-2-0400-2005/SSF7, with checks from ACCO totaling $106,030.89 from ACCO as reimbursement for hail damages to sheriff vehicles due to a storm, which occurred on May 21, 2024, as per 62 O.S. § 335, and procedures implemented by the State Auditor's Office. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #16: Motion was made by Selsor and seconded by Whitehouse to approve Utility Permit from Creek County Rural Water District #1 per County Specs for water service line, by boring, size of line 1" poly, to cross 273rd W. Ave approximately .62 miles N. of 273rd W. Ave & HWY 66, further described as 2,800' S. of the N.W. corner of Section 30, T17N, R10E in District #1. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #17: Motion was made by Selsor and seconded by Whitehouse to approve Utility Permit from Cox Communications per County Specs for cable line by replace damage coax in existing conduit, size of line 0.875, size of casing 2" conduit-existing, to cross S. 49th W. Ave approximately 0.21 miles N. of W. 151st St. S., further described as 1,075' N. of the S.W. corner of Section 16, T17N, R12E in District #1. Vote as follows: Selsor- Aye, Warner - Aye, Whitehouse - Aye.

Item #18: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government. Andrew Goforth, Assistant District Attorney stated we have filed our quarterly report. (1) No Road or Bridge projects at this time.
