The Board of County Commissioners of Creek County (BOCC) met in Regular Session on Monday, December 30, 2024 at 9:00 a.m., date and time duly posted.

Item #1: Meeting was called to order at 9:01 a.m. by Chairman, Stephens. Roll Call Stephens present, Warner present, Whitehouse present.

Item #2: Statement of compliance with open meetings act-Chairman.

Item #3: Commissioner Warner led the Pledge of Allegiance and Invocation led by Whitehouse.

Item #4: Motion was made by Warner and seconded by Whitehouse to approve the minutes of December 23, 2024. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #6: NO DISCUSSION of new business. (In accordance with the Open Meetings Act, Title 25 O.S. § 311, new business is defined as any matter not known about or which could not have been reasonably foreseen within 24 hours of time of posting agenda.)

Item #7: Motion was made by Warner and seconded by Whitehouse to award Bid#25-8 Providing and Installing Two (2) Generators for the Creek County Health Department per recommendation of Tammy Hicks, Health Department, to Apex Electric Solutions, in the amount of $132,572.00, for Sapulpa and Bristow locations, Hicks stated they were not the lowest, but they met all bid specs. The Health Department did receive a grant up to $80,000.00, for each location, to be reimbursed after completion of project. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #8: Motion was made by Stephens and seconded by Whitehouse to award Bid#25-9 Exterior Block Repair to the Creek County Courthouse per recommendation of Glen Musser, to Mid-Continental Restoration Co. Inc, in the amount of $311,293.40, this includes the options and a 10% contingency and approve paying this from the Use Tax Account 1301-1-0800-2005. Jana Thomas, Purchasing Agent stated since this is a repair over $100,000.00, we will need the following bonds: Payment, Performance, and Warranty Bonds. Stephens stated we will keep the fencing up for at least 60 days. BKL had inspected the building and recommended four locations that needed repairs. Musser stated this is an old building and we don't know what else may come up that needs to be repaired. Warner asked what the estimated completion of the project would be, Musser stated hopefully within 60 days. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #9: Motion was made by Whitehouse and seconded by Stephens to sign Resolution#2024-187 removing Requisitioning Officer Leon Warner and adding Zac Moore for Creek County Highway District #2 accounts 1102-6-4200-1110/T1A-2, 1102-6-4200-1320/T1C-2, 1102-6-4200-2005-T2-2, 1102-6-4200-4110/T3-2, 1313-6-8042-2005-HTX2-2, 1313-6-8042-4110/HTX3-2, and 1102-6-4200-4030/CBI-2, to take effect on January 01, 2025.   Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #11: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2024-189 adding Kara Fallis as Requisitioning Officer for the Creek County Election Board accounts 0001-1-2200-1110/SL1A, 0001-1-2200-1130/SL1B, 0001-1-2200-1310/SL1C, 0001-1-2200-2005/Sl2, and 0001-1-2200-4110/SL3, to take effect January 01, 2025. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #12: Motion was made by Warner and seconded by Whitehouse to sign Resolution#2024-190 adding Kara Fallis as Receiving Officer for the Creek County Election Board accounts 0001-1-2200-1110/SL1A, 0001-1-2200-1130/SL1B, 0001-1-2200-1310/SL1C, 0001-1-2200-2005/Sl2, and 0001-1-2200-4110/SL3, to take effect January 01, 2025. Stephens stated they are aware that the same person cannot requisition and receive on a purchase order. Also, this was reviewed by Andrew Goforth, Assistant District Attorney. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #13: Motion was made by Whitehouse and seconded by Stephens to sign Resolution#2024-191 employees driving home county-owned vehicles and equipment at night, to take effect January 1, 2025 as follows: District #1-Rick Selsor, Justin McCleery, Casey Copeland; District #2- Mike Anthamatten, Lance Barto, Paul Guinn, Earl Steeley, Robert (Steve) Thompson, James (Nick) Bozworth; District #3- Steven McGuire, Ryan McDaniel, Curtis Smith, Brett Wimberly, Luke VanOrsdol, Harvey Moore, Justin Evans, and Pual Cheatwood; BOCC- Ed Frank, Covy Murray, Wendy Murray, and Glen Musser. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #14: Motion was made by Warner and seconded by Whitehouse to sign the Government Product Lease Agreement and the3 Why Wait Program Agreement with Quadient Leasing for the Creek County Assessor's Office, agreement ending June 30, 2025, with the option to renew on July 01, 2025, through June 30, 2026. Haley Anderson stated this is just upgrading our equipment, we have had some problems with the current one. There is no cost increase at this time and Andrew Goforth, Assistant District Attorney has reviewed and approved contract. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye.

Item #15: Discussion and possible action regarding the American Recovery Plan 2021 funds directed to Creek County by the federal government.  (1) Motion was made by Stephens and seconded by Whitehouse to approve the Use of ARPA funds for three Water Buffalos from Wylie Sprayers of Oklahoma City, in the amount of $21,864.00, for Emergency Management. Project#1566-5.14-2700-4110(B). The Board stated it would be helpful to have a couple extra water buffalos for the county for entities to utilize. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (2) Motion was made by Stephens and seconded by Whitehouse to approve the Use of ARPA funds for a Portable Light Tower from Generac, in the amount of $11,619.50, for Emergency Management. Project#1566-8.11-2700-4110. Stephens stated would be good to have another upgraded one for the county and other entities could utilize. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (3) Motion was made by Stephens and seconded by Whitehouse to approve the transfer $23,223.50 from 1566-1-2000-1110 ARPA 2021 Salary Commissioners FY2024-2025 to 1566-1-2000-4110 FY2025, Stephens stated this is $10,260.00, less than the total of the two projects. This is because we have a credit of $10,260.00 from a reimbursement of a wrecked ARPA vehicle from the Sheriff's Office that was credited back to the account, to utilize. Vote as follows: Stephens - Aye, Warner - Aye, Whitehouse - Aye. (4) No Road or Bridge Projects at this time. Stephens stated today was the very last day to encumber funds for the ARPA Grant. We appreciate everyone that has worked diligently on this grant over the last four years. We have been able to a lot for our county.

Public Comment: The Board and Jennifer Mortazavi thanked Leon Warner for his service to our county, we appreciate you and all that you have accomplished. Stephens stated you have been a blessing to me and my family. You were able to take over some of the duties of some different board and have really made a difference. Warner stated he is lucky to work with such a tremendous group of Elected Officials. I would also like to thank my employees, you are only as good, as the people working for you. And we at District #2 have some really critical employees such as Mike Anthamatten, First Deputy and Lance Barto, Road Foreman. I appreciate the time I have served our county and have been able to do some really good things. Warner quoted Proverbs 3:5-6, if you live by this, your life will be meaningful. Mike Anthamatten, First Deputy stated it has been a blessing to work with you. You have left this county in a better place then it has ever been. Warner spoke briefly about some of his accomplishments.
